Acceptance of Terms

By registering for and using MentorGuia.com, you agree to comply with and be bound by these Terms of Use. If you do not agree to these Terms, please do not use our services.

Eligibility and Geographic Restrictions

Eligibility: You must be at least 18 years old to register for an account. You represent and warrant that all information you provide is accurate and current.

Geographic Restrictions: MentorGuia's services are available exclusively to users who are legally located in and have valid billing addresses within the United States or Colombia. If we discover or reasonably suspect that you are accessing the Site from outside these regions, we may suspend or terminate your account and refund paid fees when appropriate.

User Registration and Account Security

You agree to the following requirements whenever you create or manage your account:

  • Provide accurate, current, and complete information whenever you register or update your profile.
  • Maintain the confidentiality of your username, password, and any other credentials associated with your account.
  • Notify MentorGuia immediately of any unauthorized access or security incident involving your account.

Service Description and Role of MentorGuia

MentorGuia.com is a marketplace connecting clients with independent mentors who deliver self-improvement, professional development, and mental preparation programs. MentorGuia does not control mentor content or guarantee specific outcomes.

Financial Arrangement: Client payments are processed through our payment partner (currently Stripe). A service fee helps operate the platform and the remaining funds are disbursed to the mentor. Clients must keep billing information accurate.

Payment Processing

Payments are processed via Stripe, a PCI-DSS Level 1 certified provider trusted by companies such as Amazon, Google, and Zoom. Your payment information is encrypted and transmitted directly to Stripe - MentorGuia never stores your complete card details.

By making a payment you agree to these Terms and to Stripe's applicable terms and conditions. We may use data such as billing addresses or IP information to estimate your location, but these systems are not infallible. Your truthful representation of your location is a material condition of using the Site.

User Conduct

You agree to use MentorGuia for lawful, respectful, and professional purposes only. Misuse of the platform may result in suspension or termination.

  • Do not harass, threaten, or abuse mentors, clients, or staff.
  • Do not distribute defamatory, obscene, or otherwise objectionable content.
  • Do not transmit spam, unauthorized promotions, or malicious software through platform tools.
  • Do not attempt to gain unauthorized access to MentorGuia systems.

Intellectual Property

All content on the Site - including design, graphics, text, trademarks, and code - is the property of MentorGuia or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, or create derivative works based on the Site or services without prior written permission.

Disclaimer of Warranties and Limitation of Liability

  • The Site and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • MentorGuia disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • MentorGuia, its affiliates, and directors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Site.

Termination

We may suspend or terminate your account and access to the Site at our sole discretion, without notice, if you violate these Terms or misrepresent your location.

Changes to Terms

We may update these Terms from time to time. The latest version will always be posted on this page, and continued use of the Site constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Disputes shall be resolved exclusively in the state or federal courts located in California.

Communications and Messaging Consent

By registering for and using MentorGuia.com, you expressly consent to receive communications from us, including but not limited to essential service notices.

  • Automated SMS, email, or push notifications for session reminders, scheduling updates, chat notifications, program announcements, security alerts, and other critical updates.
  • Message frequency varies with activity (typically 1-5 messages per week).
  • Standard message and data rates may apply depending on your carrier.
  • You may opt out of non-essential communications through the provided instructions, but essential service-related messages are required while your account is active.

Indemnification

You agree to indemnify, defend, and hold harmless MentorGuia, its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Site, your violation of these Terms, or infringement of third-party rights.

Refund and Cancellation Policy

Cancellation Method: All appointment cancellations must be initiated via the user dashboard. Each appointment shows "Join" and "Cancel" actions; selecting "Cancel" immediately cancels the session and notifies both parties.

Mentor Cancellation: If a mentor cancels an appointment, the client receives a full refund (100%). Mentors should use the dashboard cancellation feature or contact support so the client is informed promptly.

Client Cancellation: If a client cancels via the dashboard, the refund depends on the time remaining before the appointment.

Client refund schedule:

  • More than 24 hours before the appointment: 95% refund for a single session and 90% refund for multi-session packages.
  • Between 12 and 24 hours before the appointment: 60% refund.
  • Less than 12 hours before the appointment: 30% refund (late cancellation fee applies).

No-show policy:

  • If the mentor does not attend, the client receives a full refund.
  • If the client does not attend without cancelling, no refund is issued.

Appointment Start Time: Once an appointment has begun it cannot be cancelled and no refund will be issued.

By scheduling an appointment on MentorGuia.com, both mentors and clients acknowledge and accept these refund and cancellation terms.
